New air quality regulations impacting South African industries

On 26 August 2024, the Minister of Forestry, Fisheries and the Environment published the Regulations for Implementing and Enforcing Priority Area Air Quality Management Plans, 2024 under the National Environmental Management: Air Quality Act 39 of 2004 (NEMAQA).

These Regulations introduce emission reduction targets and reporting requirements for businesses operating in Priority Areas, including those in mining, industry, and energy generation. Non-compliance with the Regulations constitutes an offence and may result in penalties of up to R5 million.

Key deadlines:

  • By 26 August 2026 – All Priority Area Air Quality Management Plans must be reviewed to include emission reduction targets that are aligned with the Regulations.

  • Within 6 months of review – Identified stakeholders must submit emission reduction and management plans.

  • By 31 March each year – Progress reports on emission reduction efforts must be submitted.

With the Second-Generation Highveld Priority Area (HPA) Air Quality Management Plan now in effect, industries operating with the HPA must work towards a 40% reduction in emissions by 2030. This will require strategic planning, compliance with Minimum Emission Standards published in terms of the NEMAQA, and strict monitoring.
